All holidays operated by or through TERRATREK (hereinafter called ‘the Company' or ‘we') are sold subject to the following conditions:
Prior to booking any holiday please read the tour description and these booking conditions. If you have any questions please contact us for clarification. By completing the online booking process and paying the non-refundable deposit you acknowledge you have read and agreed to these Booking Conditions. The Booking Conditions commence binding with submission of your booking online or in writing.
To make a booking >> You must send us a completed booking form and pay a non-refundable deposit for each person. The deposit shall be paid within seven working days following the reception of your booking. We will then invoice you the remainder of the cost, which you must pay no later than eight weeks (56 days) before departure. If trip departs within eight weeks full payment is required on booking and must be paid, same as with the deposits, within seven working days after receiving your booking. Acceptance of your booking will be confirmed online or in writing and a contract comes into existence on the day your deposit or full payment (if trip departs within eight weeks) is received, provided that it was received in time.
In your tour price >> Services included in the basic tour price may vary slightly from trip to trip. Each detailed trip description therefore shows a complete list of services included in the tour price.
Not included in the tour price are: flights, airport taxes, travel insurance, visas, additional pre- and post tour accommodation and transport, extra hotel services (unless otherwise stated), drinks, medical expenses, gratuities to staff and crew.
Our responsibilities >> TERRATREK is responsible to you for the proper performance of our obligations under the contract. We shall not be held liable for any damages caused to you by our failure to perform the contract or by our improper performance of the contract if such failure is: (a) attributable to you; (b) attributable to a third party unconnected with the provision of services to you; (c) due to unusual and unforeseeable circumstances beyond our control that could not have been avoided even if all due care had been taken; (d) due to an event that we with all due care could not foresee or forestall; (e) a result of accident or injury caused by your negligence in not following the safety instructions given by the tour guide.
Where the company is found liable for damages in respect of its failure to carry out the contract, the maximum amount of damages, compensation and loss of enjoyment will normally be limited to three times the basic tour price shown on the invoice.
Our responsibility does not commence until the appointed time at the designated meeting point. If you fail to arrive there at the appointed time for whatever reason, we will not be responsible for any additional expenses you may incur to meet up with the group.
Cancellations >> Cancellation or change of booking is only possible by the person whose name the holiday is invoiced to. This must be done in writing by letter or email. Depending on when we receive your notification of cancellation the following cancellation charges will apply: (a) 56 days or more before the departure date you will forfeit your deposit; (b) more than 28 days and less than 56 days a 50% refund of the tour price will be made; (c) less than 28 days before the departure date no refund will be given.
If the balance of your total booking cost is not paid in time we reserve the right to cancel your booking. In this case same cancellation charges apply as if cancelled by your part.
Rarely a situation may occur when we are forced by circumstances beyond our control to cancel a tour. We reserve the right to cancel a departure at any time. With any form of cancellation, we will offer you alternative arrangements, and if applicable a refund of the price difference. If you do not accept alternative arrangements we will refund all payments you have made to us. We will not be liable for any additional costs incurred by you.
Remember that depending on the reason for cancellation, your eventual losses may be recoverable under your insurance policy.
Amendments >> On an adventurous holiday it is essential that you accept certain measure of flexibility understanding that the itinerary, accommodation and modes of transport may be changed without notice due to circumstances beyond our control. If changes are necessary we will substitute an equal or better option. Submitting our Booking Form signifies your agreement to Terratrek making necessary changes aimed to maintain the comfort and well-being of participants without liability.
Should you need to amend your booking you can: (a) transfer from your tour to another, subject to £20 ($39 or €27) per person per trip if requested 56 days or more prior to the original tour departure date (subject to cancellation fees if requested within 56 days of original tour departure date); (b) amend arrangements made in conjunction with your tour for free if requested 56 days or more prior to the original tour departure date, then subject to £20 ($39 or €27) per change if requested within 56 days of the original tour departure; (c) transfer your booking to another person for £20 ($39 or €27) per person, provided they meet all the requirements relating to that holiday. Amendments are dependent on the availability and all fees must be paid prior to any changes being confirmed.
Refunds >> You are entitled to a full refund if your tour is cancelled by us. No refunds will be made if you leave a trip for any reason after the trip has begun. No refund or compensation will be made or given for any unused hotel accommodation, services or features of the tour. Further, you may be ordered by the leader to immediately leave the trip with no right of refund if you commit a criminal offence when on the holiday or if your behavior is causing or likely to cause danger, distress or annoyance to others.
Travel insurance >> Valid travel insurance is compulsory for all travellers on our tours. Your insurance policy must cover accidents, injury, medical expenses (including helicopter rescue and air ambulance for hiking trips), repatriation and personal liability. In your own interests we strongly recommend it covers cancellation, curtailment and loss of luggage and personal belongings. Any independent arrangements that you make that are not part of the holiday are entirely at your own risk. If bringing your own bike on one of our cycling holidays, please ensure that the bike is properly maintained and adequately insured. We will take all reasonable care when transporting bikes, however we are not responsible financially for any damage caused by a third party during our trip or in transit to the start point of the holiday.
Medical conditions >> It is your responsibility to advise us of any pre-existing medical condition and/or disability that might reasonably be expected to affect your participation in the trip. We reserve the right, at our reasonable discretion, to cancel your participation in a trip at any time, including after the commencement of your trip, with no right of refund if your medical condition and/or disability affects the normal conduct of the trip and the enjoyment of other trip members. If you are aware of any such condition please check with us suitability of the tour in question prior to booking your trip to avoid unnecessary inconvenience and disappointment.
Age and fitness >> We try not to set age limits for our tours. Rather than age you should consider your physical health and fitness with regard to the difficulty of your chosen trip. However, participants under the age of eighteen must either be accompanied by a legal guardian or provide written consent from a parent or legal guardian. If even after reading the detailed trip description you cannot assess the trip's suitability, please contact us for further advice.
